In almost every situation, if an employer has an employee working in Massachusetts, they have to extend this coverage to them. So it doesn't matter where the employer is located, it doesn't matter where the employee lives. It matters where the employee's performing their work. And so if they're performing their work in Massachusetts, they're probably going to be covered.
There's a nice test that I like to use and talk about which can help people at a very baseline to figure out who might be covered, and it's the unemployment test. So that's one of the big financial eligibility requirements in Massachusetts. So it's a good one for employers to be testing on as well. So generally, if for the particular employee you're thinking of, if you pay Massachusetts unemployment tax for that employee now, they're probably going to be eligible under the paid family medical leave program. They've set up the same financial eligibility test.
